1. Agreement
These Terms of Service ("Terms") form a binding agreement between you and Gainlabs LTD ("Gainlabs LTD", "we", "us") governing access to and use of GainWorkers (the "Platform"). By registering, signing in, depositing funds, posting campaigns, accepting tasks, using APIs, or otherwise using the Platform, you agree to these Terms, our Privacy Policy, and our Refund Policy.
2. Eligibility
- You must be at least 18 years old and legally able to enter contracts
- You must provide accurate registration information and keep it current
- Only one account per natural person is permitted unless we approve otherwise in writing
- You must not use VPNs, proxies, or false location data to bypass geo or security rules
- We may refuse, suspend, or terminate access where law, risk, or policy requires
3. Platform role
GainWorkers is an online marketplace connecting employers who publish paid tasks with workers who complete them. Gainlabs LTD provides escrow, review workflows, wallet infrastructure, trust tools, and compliance controls. We are not the employer of workers and do not guarantee task availability, approval, or earnings. Employers are responsible for lawful task instructions and budget funding.
4. Account types and workspaces
Accounts may operate as worker ("Earn"), employer ("Hire"), or both where enabled. Role-specific rules apply to job acceptance, campaign publishing, withdrawals, API usage, and verification. Admin or support access is granted only to authorised personnel.
5. Worker obligations
- Read task instructions, deadlines, geo rules, and pay rates before accepting work
- Submit honest, original proof within the Completion Window (CW)
- Do not use bots, fake accounts, stolen content, or misleading submissions
- Complete qualification, KYC, or trust requirements when prompted
- Respect employer blocks, daily capacity limits, and invite-only restrictions
- Do not attempt to move payments off-platform to avoid fees or review
6. Employer obligations
- Publish lawful tasks that do not require illegal, harmful, or deceptive activity
- Fund campaigns and Live Modes with sufficient wallet balance or approved credit
- Review proofs fairly within published Time to Rate (TTR) windows where applicable
- Do not solicit personal data from workers beyond what the task requires
- Comply with advertising, consumer, and sector rules in targeted countries
- Maintain accurate API integration settings and secure API keys
7. Wallet, escrow, and fees
The Platform uses wallet balances, holds, and escrow to manage campaign funding and worker payouts. Displayed fees, commissions, approval charges, and service fees are shown before you confirm an action. Pending, held, or reserved amounts may not be withdrawable until linked work is settled. Employer wallet top-ups and worker withdrawals are processed through cryptocurrency methods published on the Platform. Supported assets and networks are shown on the deposit and withdraw screens and may change with notice. Detailed refund rules are in our Refund Policy.
8. Platform features
These Terms apply to all current and future modules, including without limitation:
- Open Tasks, Group Tasks, and campaign workflows
- Live Broadcast and other Live Modes
- Task Hunters research bounties
- Profile Rentals and scheduled placement checks
- Arena creative tests
- Developer Hub, REST API, and SMM reseller API
- Trust Profile, Reliability Score, qualification tests, and community chat

9. API terms
- API keys are personal to your account and must be kept confidential
- You are responsible for all orders and charges placed with your key
- Rate limits, IP restrictions, and webhook settings must be configured responsibly
- Auto-deposit through API is not supported; wallet top-ups are website-only by design
- We may suspend API access for abuse, security risk, or non-payment
10. Prohibited conduct
You must not:
- Violate law, third-party rights, or platform policies
- Attack, scrape, reverse engineer, or overload the Platform
- Create duplicate, farm, or sold accounts
- Upload malware, illegal content, or deceptive proofs
- Harass users or staff in chat, tickets, or comments
- Circumvent bans, KYC, geo gates, or payout controls
11. Review, enforcement, and termination
We may review accounts, proofs, campaigns, payouts, and API activity manually or automatically. We may place holds, request additional verification, reject work, reverse balances, suspend features, or permanently ban accounts where we reasonably believe these Terms or law have been breached. You may close your account through support, subject to settlement of outstanding obligations.
12. Intellectual property
The Platform, branding, software, and documentation are owned by Gainlabs LTD or its licensors. You retain rights in content you submit, but grant us a worldwide, non-exclusive licence to host, process, display, and review that content solely to operate the Platform.
13. Disclaimers
The Platform is provided on an "as is" and "as available" basis. We do not warrant uninterrupted service, error-free operation, or specific earnings or hiring outcomes. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
14. Limitation of liability
To the fullest extent permitted by law, Gainlabs LTD shall not be liable for indirect, consequential, special, or punitive loss, or for loss of profits, data, goodwill, or business opportunity. Our total aggregate liability arising out of or relating to the Platform shall not exceed the greater of (a) fees paid by you to us in the three months before the event giving rise to the claim, or (b) one hundred pounds sterling (GBP 100), except where a higher limit is required by law.
15. Indemnity
You agree to indemnify Gainlabs LTD against claims, losses, and reasonable costs arising from your breach of these Terms, unlawful task content, misuse of the API, or violation of third-party rights, except to the extent caused by our own negligence or wilful misconduct.
16. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, without prejudice to mandatory consumer protections that may apply in your country of residence.
17. Changes
We may update these Terms from time to time. Continued use after the effective date constitutes acceptance of the updated Terms where permitted by law. Material changes may be notified on the Platform or by email.
